Will of Matthew Flinders Senior

In the sacred name of God. Matthew Flinders of Donington in the County of Lincoln, surgeon and apothecary do make this my last will and Testament. I desire that my just debts and funeral charges together with the charges for the execution of this my will may be paid as soon after my decease as possible and for this purpose I would have my £2300 of debts got in as soon as possible -which together with such cases as may be in the house -I hope may be sufficient, if not the deficiency to be made up from the sale of my drugs and fixtures. I do appoint my dear wife Elizabeth Flinders and my good friends John Hursthouse of Tidd St. Mary's in the county of Lincoln, Ezagior and Willingham Franklin of Spilsby in the said county, or in the case of the death of either or both my said friends, I do appoint Charles Hursthouse son of the said John Hursthouse and ****** Franklin, son of the said Willingham Franklin, guardians and trustees of my children. Secondly, I give and bequeath to my dear wife Elizabeth Flinders for and during the time of her natural life the following parcels, that is to say:

1 My private dwelling house, barn, stables and other outbuildings, yard, garden and paddock copyhold of the Manor of Wilbros.
2nd. Our mortgage value £200 on 12 acres of land in Donington and a house belonging to Kirli Bowers farmer of Donington.
3rd. Our other mortgage, value £200 on seven acres of land in Boston belonging to William Bowers attorney of Boston.
4th. Our promissory note value £150 from Mr. Richard Clover attorney of Donington my wife to enjoy the interest of these several sums her life.
5th. The cottage garden paddock and orchard in trust of Benjamin Simpson.
6th. Six freehold cottages and gardens in the several tenures of ******* Moor, Mary Graves, Jonathan Warriner, William ***** John Bainbridge and Elizabeth Mitchell.
7th. Eleven acres of freehold arable land in Donington in tenure of widow ****** Naylor seven parcels so marked in the ***** to this my will that my said wife enjoy the annual interest and profits of them during the term of her natural life.

I further give unto my said wife for life all the furniture, plate, linen and china, books, shop drugs and fixtures maintained in my own dwelling house and premises. and at the decease of my said wife, it is my will that all the several bequests be equally divided among such of my sons and daughters who shall then be living. Two named tenants for ******* as tenants in ****** and not as joint tenants my unfortunate son, John, with ******** or if any of them after few ****** of this my will leaving lawful ***** I would have it that they split his her and their ******* as its their payout would have been outlived as if living.

Thirdly, I give unto my two grand children, James and Susanna Harvey, three hundred and fifty pounds secured by a mortgage in copyhold land in Dray ton belonging to Mr. John Bayfiled of Quadring Eaudike and further give unto my said grandchildren secured by mortgage in the dwelling house and ****** of William Roper of Donnington that annual interest of the above sums to be applied by the guardians to the use of my said grandchildren until they attain the age of twenty one years. And if either of my said grandchildren die before they attain that age and the survivor to have his or her share. And if they both die before that age then the said £400 to go equally to my surviving children and two parcels are marked in Sil***** 27 S 22 g.

Fourthly, I give unto my unfortunate son, John Flinders our **** annuity of thirty pounds to arise from our thousand pounds in the three percents Government security marked 2.5 % **** It is my will that the Gaurdians apply this paid annuity of thirty pounds for his support during the term of his natural life and at his death to go equally among my surviving children.

Fifthly, I give and bequeath to my rwo daughters, Hannah and Henrietta Flinders twelve hundred and fifty pounds secured by mortgage and bond on lands belonging to Thomas S***** in Donington North, part free and part copyhold ***** be applied by the Guardians to the use of my said two daughters until they arrive the age of twenty one years and if either or both of my said two daughters die before that time, the respective share of the said twelve hundred and fifty pounds to go equally among my surviving children.

Sixthly, I give unto my sons Matthew Flinders and Samuel Ward Flinders jointly eleven hundred pounds in the five percents Government security. I further give unto my said sons one hundred pounds being a promissory note from my said son Samuel Ward Flinders in case of the death of my said son Samuel Ward Flinders under age, it is my will that his share of the above twelve hundred pounds go equally among my surviving children. The twelve hundred pounds are marked 22 12 e13 in ***** *****

Seventhly, I give and bequeath to my daughter Susanna Flinders the four following parcels:

I give unto my brother of the half blood William Flinders of Boston the ironmonger and his sister Mary Cawthen and his sister Penelope ten pounds each. I also give unto my two friends John Hursthouse and Willingham Franklin, appointed guardians to my children in this my will ten pounds each for mourning and as a small acknowledgement for the trouble they may have in regards this my will or in the case of their decease give the said sum of ten pounds each to their sons Charles Hursthouse and ****** Franklin appointed as succeeding guardians. I do appoint my wife, Elizabeth Flinders and my son Matthew Flinders joint executors of this my will and testament. as witness thereof I have set my hand this fourteenth day of September in the year of our Lord one thousand eight hundred and one. Matthew Flinders signed and sealed by the above said Matthew Flinders as and for this last will and testament in the presence of us, who at his request, and in the presence of each other have set our names as witness thereto: C. Shepard, Isaac Lumby, G. Ann Graham ***** by the said testator, Matthew Flinders in the presence of us who, at his request, in his presence and in the presence of each of us have subscribed our names as witnesses this eleventh day of November one thousand eight hundred and one C. I Matthew Flinders of Donington in the county of Lincoln, surgeon, so by this writing which I declare to be a codicil to my will and to be taken as a part ***** of ****** and make void the bequest and disposal of my ****** and securities for money and other personal estate therein bequeathed and disposal therein bequeathed and given to my wife Elizabeth Flinders and do by this my codicil do give and bequeath all and ***** my said monies and furniture and other personal estate therein bequeathed and given to my wife Elizabeth Flinders and do so by this codicil give and bequeath all and every my said monies and furniture and other personal estate given and bequeath unto my said wife Elizabeth Flinders together with the sum of £180 due and owing to me from Mr. Large unto my said trustees (except for my said wife) in my said will named in trust ****** for them, my said trustees, to permit and suffer the said Elizabeth Flinders to receive and enjoy ***** and ****** for and during the term of ***** life ***** further trust to permit and suffer the said Elizabeth Flinders to have, use and enjoy all and every household tools, implements of household, plate, linen, china, boots and fixtures for and during the term of her natural life and from and after her decease upon further trust that they my said trustees (except my said wife) do and shall dispose thereof in the manner ****** by me in my said will. And I do thereby order and direct my said trustees (except the said Elizabeth Flinders) shall call in and ****** all or any of my said ******* bequeathed in my said will annexed ******* and in this ******** as often as they shall find or suppose it ***** and so ****** by order direct the receipts or ****** of my said trustees (except the said Elizabeth Flinders) shall be good and sufficient discharge and discharges from time to time for all or any part of my said trust monies for which the same shall be given and that it shall and may be lawful to and for my said trustees (except the said Elizabeth Flinders) to ***** and retain to himself and all such payments and expenses as they may separately will pay ****** or be put unto the execution of the trust. Now by and in my said will in ******** in or in the ****** and proportion and they my said trustees shall not be answerable or accountable or the arts receipts or defaults or the other of them but each of them for his own arts deeds receipts and defaults only not for any loss that may happen to the said trust monies or nay part thereof by failure of any security or securities on which the same may be placed out at interest unless the same shall happen by or out of their wilful neglect or default. Also I give and ***** to my said wife Elizabeth Flinders all that my messuage with two shops ******** in Donington in the ******* of Cliscia B****** to have ******** and her assigns for and during the term of her natural life and from and after her decease then ***** the said messuage, shops garden ****** and unto all and every my sons and daughters (except my son John) his and their heirs and assigns to hold to therein as tenants in union and not as joint tenants and I do hereby ratify and confirm my said will in all the gifts devised and bequests therein and not altered and ****** I witness whereof the said Matthew Flinders have ****** set my hand and seal the 18th. day of April one thousand eight hundred and two Matthew Flinders. This writing was signed and sealed by the said Matthew Flinders and by him published and ******* as and for a codicil to his last will and testament in the presence of us who have subscribed our names as witnesses in his presence. This Will was proved at London with a codicil on the fourth day of June in the year of our Lord one thousand eight hundred and two before the Right Honourable Sir William Wyunt Knight, Doctor of Laws Rooper in conformity with the prerogative Court of Canterbury lawfully by the oath of Elizabeth Flinders widow the of the said and out of the executors in the said will to whom administration of all singular goods chattels and of the said having been first sworn by Commission duly to administer power being of making the life in to Matthew Flinders the son of the said deceased and the other executor named in the said will when he shall apply for the same.
